Can Bessler's wheel be patented?

The broader the claim the more easily it can be contested.
It has to be very precise and detailed. You cannot patent a principle or power source, only the mechanism that is derived from it. For example if electricity weren't discovered, you couldn't now patent electricity, but you can patent a generator, light bulb etc.
Just a note about the James, Ralph and Alan arrangement. Unless you have all signed a document indicating that all profits will be shared equally regardless who the inventor amongst the three of you is then you will probably end up in litigation. I strongly suggest all 3 of you sign a binding contract otherwise best to keep going it alone.

I agree and feel that you are all spot on! I would never consider presenting a patent application without full drawings and text covering description and function of each individual part in and of the embodiment before including said embodiment.to the best of my knowledge you must have drawings and a list of claims to present to the USPTO

Having a working wheel design registered somewhere is better than not at all. But even that may not be enough protection against some of the slime lurking out there. Look what happened to this guy:

in the US you can make it public and you have one year to apply for a patent
by making it public before you patent you would loose the right to file world wide patents
if you have indeed found one of the principles Bessler spoke of and you set out to patent i would say you have the worlds biggest bear by the balls and you better not turn loose or you might lose everything
if you really want to patent and try to cover all bases and don't have fifty or a hundred million that you want to tie up in court cases it could be a problem
could be cheaper if you just want to protect the one principle you may have found but still be very expensive
still that one principle is worth a heck lot
don't think too much about how many ways there may be to construct a wheel
having one principle is enough
it would be a thousand times as sweet being the first
if you want to do it the easy way file the patent then go to GE or who ever and collect a train load of up front money and another train load of royalty money every time you think about it for the next twenty years
defending the patent is always part of the deal just kick back and let GE spend their money and fight the battles for you
they already have more lawyers than could fit on one of you're money trains
don't worry about getting all the money the first hundred train loads will keep you busy counting for a while

If you are choosing between a patent and a copyright, go with patent. Below, I believe, is just about every way an invention of Bessler's wheel can be described and therefor every way a copyright wouldn't be valid.
In the US only can the inventor can apply for a patent, no matter how many people know about it, as long as public knowlege has been for less than a year before application is made, as Winkle pointed out. I understand that is not true in France, where more than the inventor can apply.
The question I would raise would be is it your invention or Bessler's? How can you know? I would focus on the adjective operative. If in a complete search of everything no one finds a wheel that is operative and yours is, I'd say you have ownership of the invention. If another operative invention shows up from the past credit can be given. For my own taste I would obtain a patent not only for my own protection, but for every other person's protection as well. Regardless the invention will fall under public ownership. Obtaining a patent to assure a public right to that public ownership makes sense to me.
