I hadn't heard a thing about this, I had to look it up with Google. These two were the first things to pop up:
http://www.ctv.ca/servlet/ArticleNews/s ... TopStories
http://www.theglobeandmail.com/servlet/ ... /National/
It seems to me that the US can't get out of Canada, because we aren't in there. We requested that the Canadian police arrest him, apparently for doing illegal business in our country. If he had refused to sell marijuana seeds to countries where it is illegal to own marijuna, then he'd have no trouble on his hands.
I just did a little research, apparently marijuana is considered to be a schedule 1 substance under title 21, section 812b of the Controlled Substances Act and as such it is illegal to import it under title 1, section 952a of the same. Of course, importers working outside the US are outside our jurisdiction and can only be apprehended, tried, and/or convicted with the cooperation of the gov't whose jurisdiction the importer is in.
Schedule definitions:
http://www.usdoj.gov/dea/pubs/csa/812.htm#b
Import restrictions:
http://www.usdoj.gov/dea/pubs/csa/952.htm#a
Personally, it seems to me that marijuana should be classified as schedule 2, but that still leaves Emery in hot water.

There is no You, as in your we Jonathan because your governing body is not you. Uncle Sam is not you.
I agree that the U.S. led arrest of Emery does not attack Canadian Sovernty as some believe because of Emery's illegal selling of seeds (by American Standards) to Americans, but there is more to the story than you are aware of. Emery donates a lot of his money to legalize pot, and some of that money went to Nevada, and other states, for the side in favor of legalizing pot. Emery's arrest is more political than anything else. He is not a "bad guy"criminal, he just believes in a cause and is fighting for it. If anything he should be tried by Canada if he is to be tried at all.

I also said "we" even though I am one. There's no reason to split hairs, you obviously knew what I meant. :|
I can see there being political motivation, the headquaters of the BC Marijuana Party he headed was raided simultaneously (with search warrant signed by Assoc. Chief Justice Dohm of the BCSC), but its not like the charges are false or illegitimate, he is on the public record confessing to two of the crimes he is charged with!

Actually Jonathan I am not spitting hairs. You at times admittedly take offense to other peoples opinions about America. Some of those opinions, and as is this one, are about the American governing body and not the American people, that's why I clarified.
Your right Emery did break American law. I hesitate to call what hes's done a crime even though technically it is labeled as such. He's been doing what he's done for over ten years now, without any harsh penalties from the Canadian authorities. All he is doing is just selling seeds. Emery says he doesn't mind if he's the sacraficial lamb as long as it gets people motivated. That shows a lot of integrity to me. I hope he is let go.
Personally I think pot should be legalized even though I don't partake in it.

re: Let Mark Emery GO!
Funny how these always seem to work out this way:
1. Where you sit is where you stand.
2. If you look for something hard enough, you'll find it!
3. Legal and illegal and right and wrong are not the same thing and should not be confused.
4. Nothing is 100%! (someone is always willing to argue the color "blue" out there)
5. You can't make a gain without a sacrifice.

I'm with you there Michael.
I bought seed from Marc 10 years ago - great guy.
Recently I learned from the local media, that the Irish govt. had signed an agreement with the US allowing the CIA to come to Ireland and take away any citizen without charge for upto 3 months for interrogation. So much for Liberty.
